These Terms of Service (“Terms”) govern your access to and use of the websites, mobile applications, and services provided by FitnessGeek Solutions (“FitnessGeek,” “we,” “us,” or “our”), including FitnessGeek Solutions, FitGeek WOG (Workout Generator), TruthGeek, and the HVAC/R TechGeek App (collectively, the “Services”). By creating an account or using our Services, you agree to be bound by these Terms.
1. Eligibility & Accounts
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use our Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Provide accurate information and keep it up to date.
2. Use of the Services
You agree not to:
- Use the Services for any unlawful purpose or in violation of these Terms;
- Reverse engineer, copy, or resell any part of the Services without permission;
- Attempt to bypass usage limits, security, or authentication measures;
- Upload harmful code or interfere with the operation of the Services; or
- Misuse AI-powered features to generate unlawful, infringing, or harmful content.
3. Subscriptions, Billing & Auto-Renewal
Certain features require a paid subscription. We currently offer a Monthly plan at $19/month and an Annual plan at $179/year. Our Free plan is available with monthly usage limits.
- Subscriptions are billed in advance on a recurring basis (monthly or annually) and automatically renew until cancelled.
- Your payment method will be charged the applicable price at the start of each billing period.
- You may cancel at any time from your account dashboard or, for purchases made through the Apple App Store, through your Apple ID subscription settings. Cancellation takes effect at the end of the current billing period, and you retain access until then.
- For purchases made through the Apple App Store, payment is charged to your Apple ID account, and subscriptions are managed by Apple in accordance with the App Store Terms of Service.
- Except where required by law, payments are non-refundable.
4. Intellectual Property
The Services, including all software, text, graphics, and logos, are owned by FitnessGeek Solutions or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services for your personal, non-commercial use.
5. User Content
You retain ownership of content you submit. By submitting content, you grant us a limited license to process and display it as necessary to operate the Services. You are responsible for ensuring you have the rights to any content you submit.
6. Health & Fitness Disclaimer
Our Services provide general fitness, wellness, and educational information and are not a substitute for professional medical advice, diagnosis, or treatment. Consult a qualified healthcare provider before beginning any exercise or nutrition program. You use fitness content at your own risk.
7. AI-Generated Results
AI-powered features generate results automatically and may contain errors or inaccuracies. Results are provided “as is” for informational purposes and should be reviewed with appropriate judgment. TruthGeek analysis is a supportive tool and not a definitive determination of truth or authenticity.
8. Disclaimer of Warranties
The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.
9. Limitation of Liability
To the maximum extent permitted by law, FitnessGeek Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue arising from your use of the Services.
10. Termination
We may suspend or terminate your access to the Services at any time for violation of these Terms. You may stop using the Services and delete your account at any time via our Account & Data Deletion page.
11. Governing Law
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict of law principles.
12. Changes to These Terms
We may update these Terms from time to time. We will post the updated version on this page and revise the “Last updated” date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
